1. Welcome to www.christinadavidsson.com (the Website) (Company name: CD Art Studio) operated by Christina Davidsson (ABN 20930858573). The Website provides you with an opportunity to browse and purchase various Products that have been listed for sale through the Website and to book Events to attend (the Services).

 

2. Acceptance of the Terms 

2.1. Please read these terms and conditions (the Terms) carefully. By using, browsing and/or reading the Website or the Services, this signifies that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Website, or any of the Services, immediately.

 

2.1. CD Art Studio reserves the right to alter, amend and update their Terms, from time to time, at its sole discretion. When CD Art Studio updates the Terms, it will use reasonable endeavours to provide you with notice of the same. Any changes to the Terms will take effect immediately from the date of their publication. The access and use of the Website by you, after CD Art Studio makes any changes, constitutes the acceptance of any such changes and you will be bound by those changes. If you do not agree to any changes, you must cease usage of the Website and Services immediately.

 

3. Definitions 

Events means in person events, workshops, and training sessions.

Product means paintings or events that are listed for sale on the Website.

Privacy Policy means the Privacy Policy found at CD Art Studio /privacy-policy/

Purchase Price means the price of the Product set out in the Sale Listing.

Sale Listing means the listing of the Products on the Website available for purchase.

You means you, the user of the Website and Services and consumer of the Products and Digital Content.

 

4. Registration 

In order to access the Events, you are required to register with the Website. As part of the registration process, you may be required to provide personal information about yourself, including the following:

(a) your name;

(b) your email address;

(c) a mailing address;

(d) your telephone number;

 

4.1. You acknowledge and agree that:

(a) any information you provide to CD Art Studio while completing the registration process will always be accurate, correct and up to date.

(b) by supplying CD Art Studio with your email address and phone number, you may receive newsletters and updates from CD Art Studio in order to keep you informed about CD Art Studio’s activities. If you do not wish to receive updates from CD Art Studio, you may unsubscribe or contact CD Art Studio at info@cdartstudio.com.au

 

5. The Products 

Purchasing the Product

(a) The Website provides you with the opportunity to purchase Products and events listed on the Website.

 

5.1. Stock Availability 

(a) CD Art Studio will endeavour to supply all Products listed on the Website.

(b) Where part of an order cannot be fulfilled at all, you will be advised as soon as reasonably possible by email.

(e) Where a Product becomes unavailable due to unexpected or high demand, and that item is ordered by you before CD Art Studio has withdrawn that item from the website, CD Art Studio will not be held responsible for the inability to complete that order, and any loss or damage that you may suffer as a result of the inability to complete that order.

 

6. Product Warranty

(a) CD Art Studio Products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure of the Product. You are also entitled to have the Products replaced if the Products fail to be of acceptable quality and the failure does not amount to a major failure (the Warranty).

 

(b) You may make a claim under this clause (the Warranty Claim) for material defects and workmanship in the Products within fourteen (14) days from the date of purchase (the Warranty Period).

 

(c) In order to make a Warranty Claim during the Warranty Period, you must provide CD Art Studio with written notice by sending an email to info@christinadavidsson.com, that includes:

(i) proof of purchase showing the date of purchase of the Product(s),

(ii) a description of the Product(s) and the price paid for the Product(s),

(iii) the reason for your claim; and (iv) photographs of the faulty item(s).

(d) Where the Warranty Claim is accepted then CD Art Studio will, replace or refund for a major failure of the Product. You acknowledge and agree that you will be solely liable for any postage or shipping costs incurred in facilitating the Warranty Claim.

(e) The Warranty shall be the sole and exclusive warranty granted by CD Art Studio and shall be the sole and exclusive remedy available to you in addition to other rights and under a law in relation to the Products to which this warranty relates.

(f) The Warranty does not apply to any appearance of the supplied Products nor to the additional excluded items set forth below nor to any supplied Products where the exterior of which has been damaged or defaced, which has been subjected to misuse, abnormal service or handling, or which has been altered or modified in design or construction.

 

6.1. Product Delivery

(a) Processing, shipment and delivery of your order is governed by the Shipping Policy, as updated from time to time. For further information on the processing of your purchase, shipment of the Product and estimated delivery times, please refer to CD Art Studio’s Shipping Policy available at CD Art Studio Shipping Policies.

 

(b) You acknowledge that the Services offered by CD ArtStudio integrate delivery (the Delivery Services) using third-party delivery companies (the Delivery Service Providers).

 

(c) In providing the Services, CD Art Studio provides you with a variety of delivery options offered as part of the Delivery Services by the Delivery Service Providers. You acknowledge and agree that CD Art Studio is not the provider of these delivery options and merely facilitates your interaction with the Delivery Service Providers in respect to providing the Delivery Services.

 

(d) In the event that an item is lost during the Delivery Services, CD Art Studio asks that you:

(i) contact the Delivery Service Provider directly to track and trace your order; and

(ii) contact us by sending an email to info@christinadavidsson.com so we can assist you with tracking and retrieving your order.

(e) CD Art Studio will take every endeavour to carefully package products, to ensure they arrive in good condition at their destination. However, due to the nature of Delivery Services you acknowledge that the outer packaging can become damaged in transit. Unless the Product(s) contained therein are damaged, faulty or unusable, the Product(s) will not be eligible for return if only the packaging is damaged. Please contact us by email info@christinadavidsson.com if you have concerns with damaged packaging of Products.

(f) If you receive an incorrect, incomplete or damaged order, please contact us within three (3) days from the date of delivery or fourteen (14) days from the date of the invoice, whichever is the sooner, and we will correct the error.

 

7. Payment 

7.1. When purchasing the Products through the Website, you agree to the payment of the Purchase Price set out on the Sale Listing on the Website for the Product or Event.

 

7.2. All prices are quoted in Australian Dollars. CD Art Studio reserves the right to change or alter the Purchase Price at any time, at their sole discretion, and without notice. Specials and bonus offers are available only while stocks last.

 

7.3. Where the option is given to you, you may make payment of the Purchase Price by way of:

(a) electronic funds transfer (EFT) into CD Art Studio’s nominated bank account.

(b) credit card Payment.

(c) stripe.

(d) Zip Pay.

(e) Afterpay; or

(f) cash.

 

7.4. Payment of the Purchase Price may be made through third party payment gateways (the Payment Gateway Provider). In using the Services, you warrant that you have familiarised yourself with, and agree to be bound by, the applicable Terms and Conditions of Use, Privacy Policy and other relevant legal documentation provided by the Payment Gateway Providers prior to you using the Payment Gateway Provider.

 

7.5. Following payment of the Purchase Price being confirmed by CD Art Studio, you will be issued with a receipt to confirm that the payment has been received and CD Art Studio may record your purchase details for future use.

 

8. Events 

8.1. Purchasing admission to Events

(d) The Website provides you with the opportunity to purchase admission to Events listed in the Sale Listing on the Website.

(e) You agree that the purchase of admission to any Event will be on the Event Terms, available at CD Art studio workshop terms

 

9.  You hereby grant to CD Art Studio and its affiliates for no consideration, a limited, non-exclusive and non-transferable license to use your Marks, on a royalty-free basis, for the sole purpose of performing the promotional activities as set forth in media or promotional guidelines (if any). All goodwill related to the use of any Marks shall inure to the benefit of the owner of such Marks. Each Mark licensor reserves the right to revoke the licensee’s permission to use the licensor’s Marks should the use be noncompliant with the media or promotional guidelines, or negatively impacts, or disparages the Mark.

 

 

 

10. Privacy

CD Art Studio takes your privacy seriously and any information provided through your use of the Website and/or the Services are subject to Privacy Policy.

WORKSHOP TERMS AND CONDITIONS

 

1 About the Workshop

1.1 Thank you for visiting our page. CD Art Studio (ABN 20930858573) offers workshops and events that provide participants with an opportunity to connect, participate and learn (the Workshops) about the art supplies and other goods that are listed for sale on the Website (the Products). Access to the Workshop and any of the associated Products, and use of the Products and Workshops, is provided by CD Art Studio.

1.2 Please read these terms and conditions (the Terms) carefully. By clicking “I agree to the Terms and Conditions” and/or by registering for the Workshop, you agree that you have read, understood and agree to be bound by the Terms. If you are registering for a child, you must be the child’s parent or guardian and agree that you and the child agree to the Terms. If you do not agree with the Terms, you must not register for the Workshop.

1.3 CD Art Studio reserves the right to review and change any of the Terms by updating this page at its sole discretion. When CD Art Studio updates the Terms, it will use reasonable endeavours to provide you with notice of same. Any changes to the Terms take immediate effect from the date of their publication. Before you continue, you should print off or save a local copy of the Terms for your records.

 

2 Offer and Acceptance of the Workshops

2.1 You may register for the Workshop by making a booking for the available Workshop through the following web address www.christinadavidsson.com or through the third-party booking website, such as Trybooking.com or Eventbrite.com, and paying the required fees for this registration, and any additional fees mentioned while making the booking. By booking the Workshops, you are offering to attend a Workshop on and subject to these Terms.

2.2 The registration for the Workshop can only be made by adults above the age or 18 years.

2.3 After booking for the Workshop, you will receive an acknowledgement confirming your order. This acknowledgement will only be an acknowledgement of receipt of the order and will not constitute acceptance of your order. CD Art Studio reserves its absolute discretion to reject your offer to register for the Workshop without having to provide you with any reason for doing same. A contract between you and CD Art Studio will not be formed until CD Art Studio accepts your order and your payment has been processed.

2.4 Once the payment has been processed, you will receive an electronic invoice.

2.5 You acknowledge and agree that CD Art Studio may, at its sole discretion, decide to change the venue where the Workshop is to be provided.

 

3 Registering for the Workshop

3.1 Prior to registering for the Workshop, you may be required to provide your or your attending child’s personal information such as your name, address, email address and phone number.

3.2 You agree that any personal information you give to CD Art Studio will always be accurate, correct and up to date.

3.3 You may not register for the Workshop and may not accept the Terms if:

(a)  you are not of legal age to form a binding contract with CD Art Studio; and/or

(b)  you are a person barred from registering for the Workshops under the laws of Australia or other countries including the country in which you are resident or from which you use the Workshops; and or

3.4 You accept any third-party booking services terms and conditions required to attend a Workshop. CD Art Studio does not own or operate the third-party and recommends that you read all third-party terms before using their services. You warrant that you have familiarised yourself with, and agree to be bound by, the applicable terms and conditions, privacy policy and other relevant legal documentation required by the third-party, prior to you using the third-party services.

 

4 Pricing

4.1 In order to register for the Workshop, you are required to pay a fee (the Workshop Fee). You agree that Workshop Fee will be forfeited to CD Art Studio if you do not attend the Workshop.

 

4.2 You agree that where there are any additional workshops or services offered by CD Art Studio, CD Art Studio is entitled to charge additional fees.

 

4.3 Whilst CD Art Studio tries to ensure that all prices which appear on the Website and the links to the Workshop page are accurate and current, errors may occur. CD Art Studio reserves the right to correct any errors and to change or update information at any time without prior notice. CD Art Studio also reserves the right to refuse any booking for registration that you may place based on information on the Workshop that may contain errors.

 

4.4 Unless otherwise stated, all amounts, described on or in connection with the Terms, are listed in Australian Dollars (AUD) 

 

5 Payment Terms

5.1 The registration for the Workshop will not be complete until the completed registration order is received by CD Art Studio and the Workshop Fee has been processed.

 

6 Cancellation and Refund

6.1 For our Workshops, if you cancel the registration, you will be entitled to refund. We’re in the middle of a pandemic. If you feel sick, stay at home.

 

6.2 You understand and agree that CD Art Studio reserves its right to cancel a Workshop in the unlikely event, if any, including unavailability of the artist or minimum number of participants not reached. CD ArtStudio will endeavour to inform you about the cancelled Workshop at least 48 hours before the Workshop commencement time.

 

6.3 You agree that in the event of any cancellation of a Workshop, at CD ArtStudio sole discretion, may either:

(a)  refund any payments that have been made.

(b)  reschedule the Workshop to an alternative date; or

(c) issue credits for the value of the Workshop Fee.

 

6.4 In the event of any cancellation of the Workshop by CD ArtStudio pursuant to the above clause 6.3, where CD ArtStudio has chosen to provide you with a refund, CD ArtStudio will refund to you the Workshop Fee within fourteen (14) business days of the Workshop date (or longer, depending on your bank or card issuer). You acknowledge and agree that we will not be responsible or liable to you in relation to this delay by your bank or card issuer in the release of funds back into your account. You agree and acknowledge that this refund will not include any additional fees, such as merchant banking/transaction fees charged by third party event booking services.

 

7 Photographs and/or videotaping

7.1 You must not take photographs, record and/or videotape the Workshop without prior consent of CD Art Studio.

 

7.2 You agree that CD ArtStudio, as the organiser of the Workshop, is entitled to take photographs and/or videotape the Workshop and any art created by you during the Workshop.

7.3 If you or your art created in the Workshop appear in the photos and/or videos, you grant to CD Art Studio and its successors an irrevocable, non-exclusive, transferrable, perpetual, royalty-free, worldwide licence to broadcast, republish, up-load to a third party, transmit, post, distribute, publicly display, and otherwise use and exploit the photos and/or videos.

 

7.4 You further acknowledge that:

(a) CD Art Studio owns all rights (including copyright) in the photos and videos;

(b) any use that CD Art Studio makes of the photos and/or videos is an authorised use; 

(c) and CD Art Studio shall not be liable to you for any infringement of any of your rights arising from its use of the photos and/or videos, including (but not limited to) claims under tort law, contract law, and the Competition and Consumer Act 2010 (Cth).

 

8 Copyright and Intellectual Property

8.1 The Website, Workshop, and all the related products of CD ArtStudio are subject to copyright. The materials and content on our Website, Workshop registration page, and at the Workshop is protected by copyright under the laws of Australia and through international treaties. Unless otherwise indicated, all rights (including copyright) in the Website’s and Workshop registration page’s content and compilation (including text, graphics, logos, button icons, video images, audio clips and software) and all materials provided to you by CD Art Studio or posted to the Website or Workshop registration page (the “Content”) are owned or controlled by CD Art Studio and are reserved by CD Art Studio or its contributors. 

 

 

9. You agree and acknowledge that you will disclose any medical condition or disability that may affect your participation in the Workshop by informing us by sending an email at info@christinadavidsson.com at least 2 weeks prior to the date of the Workshop. CD Art Studio aims to provide a safe working environment and facilitate your needs as much as CD Art Studio can without compromising the Workshop. However, CD Art Studio reserves the right to cancel your registration based on this information if the appropriate arrangements cannot be facilitated by CD Art Studio.

 

9.1. You agree and acknowledge that you will be responsible for your personal belongings with you at all times at the Workshop or the venue. CD Art Studio accepts no liability for any damage to or loss of your personal belongings brought to the Workshop by you.

 

9.2. If you are a parent or guardian of an attending child, you will be responsible for the actions of you and your child, you must ensure that the you and your child act courteously to and collaboratively with other attendees and CD Art Studio’s staff. Any dangerous, rude, or disruptive behaviour may result in your expulsion from the event without refund.

 

9.3. You agree and acknowledge that you have all the necessary insurance, including emergency medical evacuation, emergency medical expenses, personal health, etc. CD Art Studio does not accept liability for any insurance costs.

 

9.4. Whilst every reasonable precaution will be taken by CD Art Studio to ensure safety at the Workshop, CD Art Studio will not be liable, in any circumstances, for any loss or damage suffered by you or any registrant in relation to the Workshop. Nothing in these Terms shall be deemed to limit the liability of any person for death or personal injury caused by anything which it is unlawful to exclude or limit liability.

 

10 Indemnity

10.1 You agree to indemnify CD ArtStudio, its affiliates, employees, agents, contributors, third party content providers and licensors from and against all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with any:

(a)  action or inaction of you or the child that you have registered to attend the Workshop in contravention of a direction of CD Art Studio or not directed by CD Art Studio;

(b)  improper use of the Products by you or the child that you have registered to attend the Workshop;

(c) any direct or indirect consequences of you accessing, using or transacting on the Website or attempts to do so and any breach by you or your agents of these Terms; and/or

(d) any breach of the Terms.

 

11 Dispute resolution

11.1 Compulsory
If a dispute arises out of or relates to the Terms, either party may not commence any Tribunal or Court proceedings in relation to the dispute, unless the following clauses have been complied with (except where urgent interlocutory relief is sought).

11.2 Notice
A party to the Terms claiming a dispute (“Dispute”) has arisen under the Terms, must give written notice by email to the other party detailing the nature of the dispute, the desired outcome and the action required to settle the Dispute.

11.3 Resolution
On receipt of that notice (“Notice”) by that other party, the parties to the Terms (“Parties”) must:

(a)  Within seven (7) days of the Notice endeavour in good faith to resolve the Dispute expeditiously by negotiation or such other means upon which they may mutually agree;

(b)  If for any reason whatsoever, twenty-one (21) days after the date of the Notice, the Dispute has not been resolved, the Parties must either agree upon selection of a mediator or request that an appropriate mediator be appointed by and the mediation will be held in accordance with the mediation guidelines prescribed, if any, by the President of the Australian Mediation Association or his or her nominee;

(c)  The Parties are equally liable for the fees and reasonable expenses of a mediator and the cost of the venue of the mediation and without limiting the foregoing undertake to pay any amounts requested by the mediator as a pre-condition to the mediation commencing. The Parties must each pay their own costs associated with the mediation; and

(d)  The mediation will be held in Brisbane, Australia.

11.4 Confidential
All communications concerning negotiations made by the Parties arising out of and in connection with this dispute resolution clause are confidential and to the extent possible, must be treated as “without prejudice” negotiations for the purpose of applicable laws of evidence.

11.5 Termination of Mediation
If thirty (30) days have elapsed after the start of a mediation of the Dispute and the Dispute has not been resolved, either Party may ask the mediator to terminate the mediation and the mediator must do so.

11.6 Legal Proceedings
In the event that the Dispute is not resolved at the conclusion of the mediation, either Party may institute legal proceedings concerning the subject matter of the Dispute thereafter.

 

12 Venue and Jurisdiction

The Workshops offered by CD Art Studio are intended to be viewed by residents of Australia. In the event of any dispute arising out of or in relation to the Website, you agree that the exclusive venue for resolving any dispute shall be in the courts of Eastern Australia, Australia.

 

13 Governing Law
This agreement is governed by the laws of Eastern Australia, Australia. Any dispute, controversy, proceeding or claim of whatever nature arising out of or in any way relating to this agreement and the rights created hereby shall be governed, interpreted and construed by, under and pursuant to the laws of Eastern Australia, Australia, without reference to conflict of law principles, notwithstanding mandatory rules. The validity of this governing law clause is not contested. This agreement shall be binding to the benefit of the parties hereto and their successors and assigns.

 

14 Independent Legal Advice
Both Parties confirm and declare that the provisions of this agreement are fair and reasonable and both Parties having taken the opportunity to obtain independent legal advice and declare the Terms are not against public policy on the grounds of inequality or bargaining power or general grounds of restraint of trade.

 

15 Severance
If any part of these Terms is found to be void or unenforceable by a Court of competent jurisdiction, that part shall be severed, and the rest of the Terms shall remain in force.

By using or accessing CD Art Studios Website (the Website) or using CD Art Studios Services (the Services), you are giving consent to CD Art Studio for the use of your private information in the manner set out in this Privacy Policy.

(b)  when you interact with CD Art Studio electronically or in person,

5.4.  We may also use your personal information to protect the copyright, trademarks, legal rights, property or safety of CD Art Studio, the Website, its customers or third parties.

This information may be disclosed to a potential purchaser under an agreement to maintain confidentiality. CD Art Studio only discloses personal information in good faith and where required by any of the above circumstances.

                                  SHIPPING POLICY

 

Thank you for visiting and shopping at CD Art Studio. The following information sets out the terms and conditions that constitute our Shipping Policy.

1. Processing your Order 
An email confirmation is sent to your e-mail address after placing your order. Please keep this e-mail as proof of your purchase. 

2. Shipment Processing Time 
Processing time refers to the time it takes for us to prepare your order for shipping. After your payment is authorised and verified, all orders are usually processed within 2 business days. We will contact you for some reason if there are any delays. 

3. Shipping is free Australia Wide 

  • Artwork leaves the artists' studio within 3 working days (metro based artists). 

  • Non-metro artists or Aboriginal art center, dispatch is between 2-6 working days. 

  • All shipments are fully insured and trackable. You'll be emailed tracking details once the artwork is ready for dispatch. 

 

4.  International shipping 

  • All shipments are sent express with DHL, FedEx or UPS. 

  • This is added to your order when you select your country on checkout. 

  • All shipments are fully insured and trackable. You’ll receive tracking details via Email once the artwork is ready for dispatch. 

  • The receiver is responsible for international custom/fees.

 

5. Delivery Estimates

We endeavour to get your order to you as soon as possible. Once your order is placed, an estimated delivery time will be provided to you. Delivery times are estimates and commence from the date of shipment, rather than the date of order. Delivery times are to be used as a guide only and are subject to the acceptance and approval of your order. Estimated arrival dates are not guaranteed. Weather delays and other unforeseen circumstances may impact deliver time. Unless there are exceptional circumstances, we make every effort to fulfil your order.

 

5.1. Please note:

(a)  Date of delivery may vary due to carrier shipping practices, delivery location, method of delivery, and the items ordered.

(b)  We will not be responsible for wrong shipping address if you provide incorrect information.

7. Missing or Lost Package

There are several reasons why a package gets lost or becomes a delivery exception. We’ve found that, often, the package is either in the building or with a neighbour. CD Art Studio politely requests that customers look in common courier hiding spots. Please look around and let us know if you find it. If you haven’t located your order, please contact us at info@cdartstudio.com.au or 0421 165 623 to report missing or lost packages.
